These Terms and Conditions govern access to and use of the Joaquim Arnaud website and purchases made through its online sales pages. They apply to the different product categories and campaigns offered on the website, subject to any specific terms clearly displayed for each offer.
Contents
1. Company identification
The website and the sales offered through it are operated by X-Premium, Lda., Portuguese company number 509 685 633, with registered office at Largo da Igreja, 7490-421 Pavia, Portugal.
For questions about the website, products, orders or these terms, customers may contact info@joaquimarnaud.pt.
2. Scope and use of the website
These terms apply to use of the website and to distance sales contracts concluded through its sales pages. Use of the website implies that the user has read these terms, without prejudice to any legal rights they may have.
Certain campaigns, private sales, loyalty programmes or offers aimed at specific communities may be subject to additional requirements, such as registration, membership or an invitation. These requirements will be stated on the campaign page before purchase and supplement these terms; in the event of a conflict, the specific conditions prevail only for the campaign concerned, without prejudice to mandatory legal provisions.
3. Products and information
The website may feature wines, spirits and other products, as well as bundles, limited editions and seasonal offers. The essential characteristics, format, quantity, price and other relevant information will be stated on each product or campaign page.
Reasonable measures are taken to ensure that descriptions, photographs and information are accurate. Images may be illustrative and the visual presentation may vary slightly, provided this does not alter the essential characteristics of the product purchased. The specific information shown at the time of purchase applies to that order.
4. Prices, taxes and charges
Prices and the applicable currency are those shown on the product page and in the order summary, including taxes legally due where applicable. Any additional charges, including delivery costs, will be shown to the customer before they complete the purchase.
Unless expressly stated otherwise, campaign prices and terms apply only during the advertised period and while stocks last. An obvious material error in a price or description will be handled in accordance with applicable law, and the customer will be informed before any change is made to the order.
5. Orders and availability
To make a purchase, customers must provide complete and accurate information and follow the checkout steps. Before submitting an order, they will have the opportunity to review the products, quantities, total price, contact details, delivery and payment.
Automatic acknowledgement of receipt does not necessarily mean final acceptance of the order. The order will be considered confirmed as communicated to the customer, following any necessary checks and confirmation of payment where applicable.
Acceptance is subject to product availability, payment validation and compliance with any clearly stated eligibility conditions. If a product already paid for cannot be supplied, the customer will be informed and receive any refund due under applicable law.
Any per-customer unit limits, limited quantities or campaign deadlines will be stated on the relevant sales page.
6. Payments
Available payment methods are those displayed at checkout at the time of purchase. Electronic payments may be processed by external payment service providers in accordance with their terms and security measures.
An order will be processed as paid only once payment has been confirmed. The seller will not ask customers to send full bank card details or online banking credentials by email. If payment is declined, interrupted or unconfirmed, the order may not be completed.
7. Delivery and transfer of risk
Delivery options, covered areas, costs, estimated times and any collection options are stated on the product page or during checkout. Arrangements may vary according to the product, campaign, address and operational availability.
Customers are responsible for providing a correct address and ensuring that the order can be received. If personal delivery coordination is required, the seller will contact the customer using the details provided.
The stated delivery times are those communicated before purchase and must be met in accordance with applicable law. The risk of loss or damage transfers as provided by law, including upon physical delivery to the consumer or a person designated by them, subject to statutory exceptions.
8. Withdrawal, cancellations and returns
For distance contracts, consumers benefit, where applicable, from the statutory right of withdrawal. As a rule, the period is 14 consecutive days and, for goods, begins on the date the consumer or a designated third party takes physical possession, subject to applicable legal rules.
The law provides exceptions to the right of withdrawal for certain goods and situations. Whether an exception applies depends on the specific product and applicable legal requirements; no entire product category is presumed to be automatically excluded.
Consumers may communicate their decision unequivocally by contacting info@joaquimarnaud.pt or by any other legally accepted means. Exercising this right is not conditional on using a specific form. Refunds, return costs and any liability for diminished value of goods will be handled in accordance with the law.
Any additional commercial cancellation or returns policy will be shown on the relevant page and may not reduce consumers’ mandatory rights.
9. Non-conforming or damaged products
If a product is damaged, incomplete, non-conforming or does not match the order, customers should contact info@joaquimarnaud.pt and describe the issue. Photographs and the order number may help resolve the matter more quickly.
This communication does not limit or replace consumers’ statutory rights concerning conformity, warranties or other rights provided by law.
10. Products subject to age restrictions
Where alcoholic beverages are offered, purchases and deliveries are exclusively for people of the legal age to purchase those products in Portugal, and never for anyone under 18. Customers declare that they meet this requirement and may be asked to provide identification on delivery.
The seller may refuse or decline to complete a sale or delivery where compliance with applicable legal requirements cannot be confirmed.
11. Campaigns and special offers
Promotional campaigns, discount codes, bundles, launches and exclusive offers may have their own conditions, including expiry dates, maximum quantities, eligibility criteria or territorial restrictions. These conditions will be clearly communicated on the campaign page or before the purchase is completed.
Unless stated otherwise, offers cannot be combined with other campaigns. This rule applies only where clearly stated and legally permitted.
12. Data protection
Personal data provided through the website are processed for purposes such as order management, payments, invoicing, delivery, customer support and compliance with legal obligations, in accordance with the Privacy Policy published on the website.
Customers should consult the Privacy Policy for information about the data controller, legal bases, recipients, retention periods and how to exercise rights relating to personal data.
13. Support, complaints and dispute resolution
For support or to submit a complaint, customers may contact info@joaquimarnaud.pt. Where applicable by law, consumers may use the Complaints Book and refer a matter to a competent consumer alternative dispute resolution entity.
Before final publication, the official complaint and alternative dispute resolution information and links applicable to the company should be made available on this page or on a contact page.
14. Intellectual property
Unless stated otherwise, the website’s text, photographs, logos, graphic elements and other content are protected by intellectual property rights and may not be reproduced, distributed or used commercially without the rights holder’s permission, except where permitted by law.
15. Liability and website availability
Reasonable efforts are made to keep the website accessible and its information up to date. Temporary interruptions may occur due to maintenance, technical failures or circumstances beyond the operator’s control.
Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, or consumers’ mandatory rights.
16. Changes to these terms
These terms may be updated to reflect legal or operational changes or changes to the services offered. The version applicable to an order is the one shown to the customer before that purchase is completed. The date of the latest update will be shown on this page.
17. Governing law
These terms are governed by Portuguese law, without prejudice to mandatory consumer protection provisions that may apply. Nothing on this page affects rights granted to consumers by law.
